LOYALty Terms and Conditions

1. Program Overview
By enrolling in or participating in the Rock 'N' Air Adventure Park Loyalty Program (the "Program"), you agree to these Terms and Conditions (the "Terms"). In these Terms, "you" and "Member" refer to the individual who enrolls in and participates in the Program. You acknowledge that you have read, understood, and agree to these Terms. The Program allows eligible guests to earn points, rewards, and other benefits based on qualifying activities at participating Rock 'N' Air locations.
The specific earning rules, reward types, redemption values, eligibility requirements, and expiration periods that apply to the Program at any given time are set forth in the Program Schedule, which is available at www.rocknair.com and forms part of these Terms. The Program Schedule may be updated from time to time in accordance with Section 7.
The Program is administered by Rock N Air, L.L.C. and may be offered through one or more of its affiliates. Rock N Air, L.L.C. and its affiliates are collectively referred to in these Terms as "Rock 'N' Air," "we," "us," or "our."
2. Eligibility & Enrollment
• Enrollment is open to individuals who are at least eighteen (18) years of age.
• Individuals under the age of eighteen (18) may participate in the Program only through a loyalty account created and controlled by a parent or legal guardian who enrolls and manages the account on their behalf. By permitting a minor to participate, the parent or legal guardian agrees to these Terms and accepts responsibility for the minor's participation in the Program.
• We do not knowingly collect personal information directly from children under the age of thirteen (13) or permit them to enroll independently in the Program.
• You must provide accurate, current, and complete contact information to enroll and receive rewards.
• Participation is limited to one loyalty account per person. We reserve the right to merge, suspend, or close duplicate accounts.
• When you enroll in the Program, your loyalty account may be linked to an online account. If you do not already have an online account, one may be created for you as part of the enrollment process.
• By creating an online account with Rock 'N' Air, you may automatically be enrolled in the Program and these Terms will apply to you.
3. Earning Points and Rewards
You may earn points and rewards by completing qualifying activities as described in the Program Schedule. The Program Schedule sets forth the earning rules currently in effect, including qualifying activities, point values, rewards, and any applicable conditions or exclusions.
Points and progress toward rewards are calculated based on the final amount paid after discounts, refunds, credits, chargebacks, or adjustments.
We reserve the right to adjust, deduct, cancel, or correct points or rewards credited in error or resulting from fraudulent, abusive, or unauthorized activity.
4. Redeeming Rewards
Rewards earned through the Program may be redeemed as described in the Program Schedule.
General redemption conditions:
• Rewards have no cash value and are not redeemable for cash, gift cards, stored value, or credit except where required by law.
• Rewards are personal to the enrolled member and may not be sold, transferred, assigned, exchanged, or combined with another member's rewards.
• Rewards may only be redeemed at participating Rock 'N' Air locations.
• We reserve the right to establish redemption limits, blackout dates, exclusions, and other reasonable restrictions.
• Lost, expired, forfeited, or deleted rewards will not be replaced except at our sole discretion.
5. Expiration of Points and Rewards
Points and rewards are subject to expiration as set forth in the Program Schedule. Different reward types may have different expiration periods.
Unless otherwise stated in the Program Schedule, points and rewards expire twelve (12) months after they are earned or issued.
It is your responsibility to monitor your account and redeem points and rewards before they expire.
Expired points and rewards are automatically forfeited and may not be reinstated except at our sole discretion.
Points and rewards are promotional in nature, have no cash value, do not constitute property of the member, and are not transferable except as expressly permitted by Rock 'N' Air.
6. Promotional Offers
From time to time, we may offer promotions that temporarily modify or supplement Program benefits, earning opportunities, or rewards.
Each promotion may be subject to separate terms and conditions, including eligibility requirements, earning limitations, expiration periods, and exclusions.
Promotional offers are available only during the stated promotional period and do not create any ongoing entitlement beyond that period.
7. Program Changes
We reserve the right, in our sole discretion, to modify, suspend, restrict, or terminate the Program, these Terms, or the Program Schedule at any time and for any reason, including, without limitation, changes to:
• Earning rules and earning rates
• Reward structures and redemption requirements
• Point values
• Membership eligibility
• Expiration periods
• Participating locations
• Available benefits and rewards
Participation in the Program does not create any vested right or property interest in any points, rewards, benefits, or membership status.
All points, rewards, benefits, and membership privileges remain subject to modification, cancellation, suspension, or termination by Rock 'N' Air at any time.
Where practicable, we may provide notice of material Program changes through email, website postings, account notifications, or other reasonable means. However, we are not obligated to provide advance notice except where required by applicable law.
Your continued participation in the Program following any modification constitutes acceptance of the revised Terms and Program Schedule.
If you do not agree to any modification, your sole remedy is to terminate your participation in the Program.
8. Closing, Suspension, and Termination of Accounts
a) By You
You may close your loyalty account at any time by contacting us at info@rocknair.com.
Any unredeemed points or rewards remaining in your account at the time of closure will be forfeited unless otherwise required by law.
b) By us
We may suspend, restrict, or terminate your account at any time if we reasonably believe you have:
• Violated these Terms;
• Engaged in fraudulent, deceptive, abusive, or unauthorized activity;
• Misused the Program;
• Provided false information; or
• Engaged in conduct that may harm Rock 'N' Air, its guests, employees, or systems.
c) Program Discontinuation
If we discontinue the Program entirely, all points, rewards, and benefits may be canceled effective on the termination date announced by Rock 'N' Air, subject to any requirements of applicable law.
d) Fraud, Abuse, and Errors
We reserve the right to audit any loyalty account at any time.
Points, rewards, benefits, or membership status obtained through fraud, abuse, misuse, technical error, system malfunction, administrative error, or activity inconsistent with the intended operation of the Program may be withheld, revoked, canceled, or adjusted without notice.
Our decisions regarding Program administration, account activity, point balances, and reward eligibility are final and binding.
9. your account
• You are responsible for maintaining accurate account information and safeguarding your account credentials.
• You should review your account regularly for accuracy.
• If you believe an error has occurred, you must notify us within thirty (30) days after the issue is discovered.
• We reserve the right to require reasonable proof before correcting any claimed account error.
10. Communications
By joining the Program, you consent to receiving transactional communications regarding your account, including reward notifications, redemption confirmations, expiration notices, account updates, and Program changes.
You may also receive marketing and promotional communications relating to the Program and Rock 'N' Air Adventure Park.
You may opt out of marketing communications at any time using the unsubscribe instructions provided in those communications.
Opting out of marketing communications will not affect our ability to send transactional or account-related communications.
11. Privacy
Your personal information will be collected, used, stored, and disclosed in accordance with our Privacy Policy, available at https://www.rocknair.com/privacy-policy.
By enrolling in the Program, you acknowledge that you have reviewed and understand our Privacy Policy.
We may use your information to administer the Program, track purchases, calculate rewards, communicate with you, analyze Program performance, improve guest experiences, and conduct business operations.
We may share information with service providers who assist us in operating the Program, processing transactions, administering rewards, and providing related services.

12. Disclaimer of Liability
To the fullest extent permitted by law, Rock 'N' Air shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to participation in the Program.
We are not responsible for:
• Lost, delayed, misdirected, or undelivered communications;
• Technical malfunctions or system failures;
• Unauthorized account access;
• Errors in calculating or awarding points or rewards; or
• The expiration, forfeiture, suspension, or cancellation of points, rewards, or benefits in accordance with these Terms.
Nothing in these Terms limits any rights that cannot be waived under applicable law.
13. Force Majeure
Rock 'N' Air shall not be responsible for any delay, interruption, or failure in the operation of the Program resulting from causes beyond its reasonable control, including acts of God, natural disasters, severe weather, governmental actions, labor disputes, power outages, internet failures, cyber incidents, equipment failures, public health emergencies, or failures of third-party service providers.
14. Taxes
Members are solely responsible for any federal, state, local, or other taxes that may arise from rewards, prizes, benefits, or other Program-related items received by the member.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles.
Any legal action relating to the Program shall be brought exclusively in the state or federal courts located in New Jersey, and participants consent to the jurisdiction of those courts.
Nothing in these Terms limits any rights you may have under applicable consumer protection or privacy laws.
